The following Terms & Conditions (the “Terms”) govern your use of the websites, mobile applications, products, hardware, tools, and services (collectively, the “Products”) offered by DrivaLogTech (“DrivaLogTech,” “we,” “us,” or “our”). By accessing or using any of the Products, you acknowledge that you have read, understood, and agree to these Terms, which form a binding agreement between you and DrivaLogTech. If you do not accept these Terms, do not use any of the Products.

1. Changes to Terms

DrivaLogTech reserves the right to modify these Terms at any time. The most current version will always be posted on our website (www.drivalogtech.com). Your continued use of the Products after changes are posted constitutes acceptance of the revised Terms.

2. Privacy Policy

We collect personal information, including but not limited to:

    We may collect the following types of information:
  • Name, email, phone number
  • Billing/shipping addresses
  • Payment details (credit card, tax ID, etc.)
  • Device usage data

Our Privacy Policy (available at www.drivalogtech.com/privacy-policy) explains how we handle your data. By using our Products, you consent to our data practices.

3. Security

You are responsible for:

  • Keeping login credentials secure
  • Updating account information (email, mailing address, etc.)
  • Notifying us of unauthorized access

DrivaLogTech will never ask for your password but may request verification details for security purposes.

4. Hardware Devices & Subscriptions

4.1 General Terms
  • Devices may require upfront payment + a non-refundable subscription (monthly/quarterly/yearly).
  • Subscription plans auto-renew unless canceled 7 days before renewal via written notice (email to drivalogtech@gmail.com)
  • No refunds for partial subscription periods.
4.2 Refund & Return Policy
  • First-time customers may request a full refund within 5 days of purchase, provided the hardware is returned unused, in original packaging, at the customer’s expense (shipping + insurance).
  • Restocking fees (up to 15%) may apply.
  • Existing customers are not eligible for hardware refunds.
4.3 Leased Devices (e.g., Bluetooth ELD)
  • Leased devices remain DrivaLogTech property.
  • Must be returned within 30 days of cancellation or upon request.
  • Lost/damaged device fee: $150 + taxes per device.
  • Services continue until the device is returned or the fee is paid.
4.4 SIM Cards (Wired ELD, Trackers, Dashcams, etc.)
  • Provided SIM cards are for DrivaLogTech use only.
  • Unauthorized use may result in service termination.

5. Online Purchases

  • Orders are offers subject to DrivaLogTech’s acceptance.
  • Payment terms are at our discretion.
  • No mid-term subscription changes—modifications require written approval.
  • You warrant that payment details are accurate and authorized.

6. Warranties & Replacements

  • Limited Hardware Warranty: Devices are free from defects for the Warranty
  • Malfunctioning devices:
    • Free replacement for non-physical damage (customer must return the defective unit within 30 days).
    • Failure to return incurs a $150 fee.
  • Customer covers shipping costs for returns.

7. International Use

Products are designed for U.S. use only. Compliance with local laws outside the U.S. is your responsibility.

8. Indemnification

You agree to indemnify DrivaLogTech against any claims, damages, or expenses (including legal fees) arising from:

  • Your misuse of Products
  • Violations of these Terms or third-party rights
  • Breach of applicable laws

9. Intellectual Property

  • License: DrivaLogTech grants a non-exclusive, non-transferable right to use Products per these Terms.
  • Restrictions: No reverse engineering, resale, or unauthorized use of content/logos.
  • Trademarks: “DrivaLogTech” and its logos are proprietary—use requires written permission.

Disclaimers & Liability Limits

  • No warranties: Products are provided “as is” without guarantees of accuracy or reliability.
  • No liability for indirect, incidental, or consequential damages (where permitted by law).
  • Sole remedy: Discontinue use if dissatisfied.

11. Dispute Resolution

  • Class Action Waiver: Claims must be brought individually, not as class actions.
  • Arbitration: Disputes may be resolved via binding arbitration under American Arbitration Association (AAA) rules, applying New Jersey law.
  • Governing Law: All legal actions must be filed in state/federal courts in Middlesex County, NJ.
